1. Scope of application

These General Terms and Conditions (GTC) govern the use of this website as well as the commercial relationships between ADN Brands Sàrl, (hereinafter ADNBRANDS.CH - www.adnbrands.ch )and its users. They are applicable in their version in force at the time of access to the site or the ordering of products. The offer available on this site is exclusively aimed at customers residing in Switzerland or in the Principality of Liechtenstein.

The term "customer" refers to any natural or legal person having a commercial relationship with ADNBRANDS.CH. The GTC, payment and delivery terms, as well as provisions relating to data protection may be modified at any time. ADNBRANDS.CH recommends reading these terms and provisions carefully during each use of the site or ordering of products.

These GTC are exclusively applicable. Any divergent, supplementary or contradictory condition requires explicit written acceptance from ADNBRANDS.CH to be valid. By using this site or placing an order, the user expressly acknowledges having read and accepted the entirety of these GTC, including the delivery and payment terms.

If any provisions of the GTC become null or unenforceable, this shall not affect the validity of the other clauses.

This website is administered by ADNBRANDS.CH.

2. Information about the site

The ADNBRANDS.CH site provides information regarding the products and services offered. Changes to prices, the range of products, and technical specifications remain possible at any time. All information present on  www.adnbrands.ch (descriptions, illustrations, videos, dimensions, weight, technical specifications, accessories, etc.) are provided for informational purposes only and do not constitute any guarantee or firm commitment, unless explicitly stated otherwise.

ADNBRANDS.CH strives to provide accurate, complete, up-to-date, and understandable information, but no explicit or implicit guarantee is given in this regard.

All offers on this site are made without contractual obligation.

The availability of products at the time of order cannot be guaranteed. Therefore, information regarding stock and delivery times is provided without guarantee and may be changed at any time and without notice.

3. Prices

The prices displayed on ADNBRANDS.CH include, unless otherwise stated, the applicable value-added tax (VAT), as well as any advance recycling fee (ARF) or intellectual property rights applicable to electronic devices. Prices are quoted in Swiss francs (CHF) and are net.

Unless specifically stated, delivery charges are not included and must be paid by the customer. These charges are specified separately during the ordering process.

ADNBRANDS.CH reserves the right to make technical changes, price adjustments, or corrections in the event of errors or typographical mistakes at any time and without notice. The prices indicated do not include consulting services or technical assistance.

4. Contract

The offers available on this website constitute a non-binding invitation to order products or services offered by ADNBRANDS.CH. By submitting an order and accepting the terms and conditions, the customer makes a binding offer to establish a contract. An automatic "order confirmation" is then sent by email, confirming the receipt of the order.

Orders are binding for the customer. Unless otherwise stated, there is no right of return or withdrawal.

The contract is deemed to be concluded when ADNBRANDS.CH sends an email confirming the dispatch of the ordered products or services.

Deliveries are made only after full payment has been received (unless delivery is on invoice) and subject to the availability of the items. If, after the conclusion of the contract, it turns out that all or part of the ordered items cannot be delivered, ADNBRANDS.CH has the right to terminate the contract in whole or in part. In the event of termination, any amounts already paid by the customer will be refunded. If no payment has been made, the customer is released from any payment obligation. ADNBRANDS.CH is not obliged to offer a replacement product in the event of contract termination.

5. Payment methods and retention of title

The available payment methods are indicated during the ordering process.

ADNBRANDS.CH reserves the right to refuse certain payment methods at its sole discretion or to require advance payment.

If payment is not made within the specified time, the entire invoiced amount becomes due and the customer is considered to be in default of payment, without the need for a reminder.

In the event of late payment, ADNBRANDS.CH may appoint a collection agency in Switzerland or abroad, or assign the debt. Reminder fees of 20 CHF per reminder as well as late interest of 14.9% per annum may be applied.

The delivered products remain the property of ADNBRANDS.CH until full payment is received.

6. Delivery, verification and return

Items are shipped by postal mail or by a courier service to the address provided by the customer at the time of ordering. Invoicing is done by email or by postal mail. The risks associated with shipping are transferred to the customer as soon as the goods leave the premises of ADNBRANDS.CH.

If delivery cannot be made or if the customer refuses to accept it, ADNBRANDS.CH has the right, after sending a reminder by email and the expiration of an appropriate period, to terminate the contract and charge for incurred costs.

The customer is obliged to check the goods upon receipt and to report any defects in writing without delay, by postal mail or email.

Returns are made at the customer's expense and risk. Products must be returned in their original packaging, complete, accompanied by all accessories and the delivery note.

If the inspection reveals that the returned product has no defects or that the defect is not covered by the warranty, ADNBRANDS.CH reserves the right to charge for processing, return or disposal fees.

7. Right of withdrawal

The customer has a right of withdrawal valid for 14 calendar days from the receipt of the goods. To comply with this period, the customer must notify their withdrawal in writing, either by email to the address info@adnbrands.ch, either by postal mail to ADNBRANDS.CH (Silverbogen AG, Eichstrasse 44, 8152 Glattbrugg), before the expiry of this period. The withdrawal does not require any justification.

Exercising the right of withdrawal results in the termination of the contract. The customer must return the goods within 14 calendar days from the notification of withdrawal. The products must be returned in their original packaging, complete, accompanied by all accessories, the delivery note, and to the address specified by ADNBRANDS.CH. Return shipping costs are the responsibility of the customer.

Any amount paid by the customer will be refunded within 20 calendar days, provided that ADNBRANDS.CH has received the returned products or the customer provides proof of dispatch.

In the event of deterioration, excessive wear, or any other loss of value attributable to improper use of the item, ADNBRANDS.CH reserves the right to deduct the corresponding value from the refund or to claim compensation.

The right of withdrawal does not apply in the following situations:

​1. contracts concerning goods whose price depends on market fluctuations that the seller cannot control;

​2. perishable products or those whose nature makes them unsuitable for return;

​3. items made to the consumer's specifications or clearly ​customised;

​4. digital content not supplied on a tangible medium, if the contract has been fully performed with the consumer's consent;

​5. services performed in full before the end of the withdrawal period with the express prior consent of the customer;

6. contracts concerning services in the fields of accommodation, transport, catering or leisure, for which a date or period of execution is agreed.

8. Prohibition of sale to minors

The sale of alcoholic beverages is strictly prohibited to persons under the age of 16, and the sale of spirits to those under 18, in accordance with Swiss legislation. By placing an order on  www.adnbrands.ch, the customer confirms compliance with these legal provisions and declares to be authorised to make the purchase. ADNBRANDS.CH disclaims any responsibility in the event of false declaration or fraudulent use.

9. Warranty

ADNBRANDS.CH guarantees products of impeccable quality. If defects are reported within the prescribed time limits, ADNBRANDS.CH, during the legal warranty period generally set at two years from the date of delivery, undertakes to repair the products, replace them or refund their purchase price.

Any other claims, particularly for indirect or consequential damages, are excluded.

The warranty does not cover:

• normal wear and tear;
• damage resulting from inappropriate use or incorrect maintenance by the customer or third parties;
• defects caused by external influences;
• wear parts or consumables.

ADNBRANDS.CH does not guarantee the continuous availability of its website nor the accuracy, completeness or timeliness of the information provided, hyperlinks or other content.

10. Liability

The liability of ADNBRANDS.CH is limited to the extent permitted by law. It does not cover direct or indirect damages, financial losses, or any other material or personal harm suffered by the customer.

The hyperlinks present on the ADNBRANDS.CH site are provided solely to simplify access to other sites. ADNBRANDS.CH has no control over the content of these sites and disclaims any responsibility for their use.

11. Data Protection

1. ADNBRANDS.CH is authorised to use the personal data obtained during the conclusion of the contract for contractual execution and marketing purposes. This data may be passed on to third parties involved in order processing, such as logistics partners.

12. Final Provisions

ADNBRANDS.CH reserves the right to modify these terms and conditions at any time, without prior notice.

In the event of a dispute, only Swiss law shall apply, excluding conflict of law rules and the Vienna Convention on Contracts for the International Sale of Goods (CISG).

The legal jurisdiction is set in Neuchâtel, unless otherwise provided by law.

These terms and conditions in French are a translation of the original text written in German. In case of discrepancies, only the German version shall prevail.

13. Delivery Charges

The shipping costs for Switzerland and Liechtenstein are as follows:

1. Orders up to 80 CHF: 9.90 CHF
2. Orders from 80 CHF: free delivery

Private customers :

1. Orders up to 200 CHF (excluding VAT): 15 CHF
2. Orders from 200 CHF (excluding VAT): free delivery

Professional customers – Catering :

1. Orders up to 500 CHF (excluding VAT): 15 CHF
2. Orders from 500 CHF (excluding VAT): free delivery
